The dynamic mobility of contemporary people and the development of international circulation are prerequisites for having a lot of citizens living or staying within the territory of a country other than their country of origin. They often encounter technical difficulties when using official documents issued abroad (letters of attorney, declarations, birth certificates, marriage certificates, etc). The adaptation to the administrative particularities of the countries takes time and additional expenses. On the other hand, the legal regulation is contained in the sources of three legal spheres – the national legislation, the multilateral and bilateral treaties, and the EU law. The diversity of legal sources results in hesitation about the interrelation among them and the regime applicable to these documents. This work focuses on the mechanisms of recognition in the Republic of Bulgaria of official documents issued abroad, and vice versa. It analyses the procedure of affixing the ‘apostille’ certificate under the Hague Convention of the year 1961, the legalisation procedure and the mechanisms underlying the bilateral treaties of legal aid. These treaties exempt the official documents from legalisation and affixation of an ‘apostille’ under the Hague Convention. This work also deals with the court practice on this matter. These procedures are too sluggish and timeconsuming for the needs of the EU single market. Regulation (ÅU) 2016/1191 will apply from 16 Feb. 2019 onwards. It introduces the issuance of multilingual standard certificates that will be attached to the official documents for the purpose of facilitating the translation and overcoming the language barriers within the Union. |
