The subject matter of this study consists in the issues raised by contracting a court settlement in the proceedings of court partition. A brief general characterization is given of the essence and the legal nature of court settlement as a procedural institute. An examination is made of the various aspects of contracting a court settlement in partition proceedings, taking into account its specificity. An analysis is done of the possibility of contracting a court settlement at the first stage of a court partition - in the proceedings of its admission. Special attention is given to the different views on matters of dispute in legal doctrine and judicial practice, and a stance is taken on the legal issues raised therein. Judicial acts of the Supreme Court of Cassation and the courts of lower instances are analyzed, which might be of interest to each jurist. |
