The article studies in detail the commutation of life imprisonment through its judicial replacement with a 30-year imprisonment under Article 38a, paragraph 3 of the Criminal Code and the judicial and prosecutorial practice which has evolved since the introduction of this legal provision. The article discusses the conditions under which the replacement is applicable, the approaches of the courts and the prosecution towards the determination of these conditions, as well as selected cases which demonstrate these approaches. The relations of the replacement to the conditional early release under Article 70 of the Criminal Code are analysed. A conclusion is made that the replacement is not suitable as a legal tool for amending possible judicial errors in cases of imposition of life imprisonment under the less beneficial penal law in contradiction to Article 2, paragraph 2 of the Criminal Code. |
